Ben Byford Store Terms

Preamble

In all of the following text the term "BB Store" refers to the developers of the Ben Byford Store, "Technology and Creativity Limited", "Ben Byford", and any company or individual involved in the development, administration or maintenance of this site.

Disclaimer

Items sold from the BB Store are developed, supported and sold by 3rd party authors. The BB Store exists purely as a download service between you and the author. BB Store provide NO guarantees, warranties or support for products sold in the BB Store. These are provided only by the authors of items, and you should contact them for any questions you have before completing a purchase.

In no event shall BB Store or authors of items downloaded from the BB Store be liable for any special, indirect, consequential, exemplary, or incidental damages whatsoever, including, without limitation, damage for loss of business profits, business interruption, loss of business information, loss of goodwill, or other pecuniary loss whether based in contract, tort, negligence, strict liability, or otherwise, arising out of the use or inability to use services or software downloaded from the Marketplace, even if advised of the possibility of such damages.

Distribution

Unless the author of an item states otherwise, you may not distribute items downloaded from the BB Store, except for the site they were purchased for, and any staging/development servers related to the site.

Refunds and fees

Refunds are provided by the BB Store within 7 days of purchase if it has been determined that the downloaded item dose not work, and, you have contacted the author for support, and they have been unable to resolve the issue for you. Outside of that, no refunds are provided by the BB Store. However, 3rd party authors may provide refunds, and that is completely between the author and you. If you have any questions on refunds, please contact the author before completing a purchase.

The ProcessWire Marketplace does not collect additional fees or taxes except where required in our local jurisdiction. If your location requires any kind of other taxes or fees of any sort, they are your responsibility. Should any such fiscal obligations apply, please do not purchase from the BB Store unless you will be fulfilling those obligations yourself.

Warranty

For items in the marketplace that DO state a warranty: Any warranty (if available) is provided only by the author of the item, not by BB Store. Please contact the author for any questions you have on the warranty before making a purchase.

For items in the marketplace that DO NOT state a warranty: These items are provided "as-is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of these items is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.

The BB Store is here to support your ability to download any items purchased. Should you have any trouble completing your download, please contact us here hello@benbyford.com.

After purchase, we require authors of sold items to support their product for a minimum of 30 days (unless the author states a longer support period). This support for downloaded items is the sole responsibility of the author(s), not BB Store. Should you be unable to obtain support from the author, please contact us so that we can connect you with them. Should you have any questions about length/availability support, please contact the author of the item before completing the purchase.

Software product terms

Feature Request

Licensee may request additional features in Software, provided, however, that (i) Licensee shall waive any claim or right in such feature should feature be developed by Licensor; (ii) Licensee shall be prohibited from developing the feature, or disclose such feature request, or feature, to any 3rd party directly competing with Licensor or any 3rd party which may be, following the development of such feature, in direct competition with Licensor; (iii) Licensee warrants that feature does not infringe any 3rd party patent, trademark, trade-secret or any other intellectual property right; and (iv) Licensee developed, envisioned or created the feature solely by himself.

Bug Notification

Licensee may provide Licensor of details regarding any bug, defect or failure in The Software promptly and with no delay from such event; Licensee shall comply with Licensor's request for information regarding bugs, defects or failures and furnish him with information, screenshots and try to reproduce such bugs, defects or failures. Bugs should be reported to the specific author of each product.

Upgrades, Updates and Fixes

Licensor may provide Licensee, from time to time, with Upgrades, Updates or Fixes, as detailed herein and according to his sole discretion. Licensee hereby warrants to keep The Software up-to-date and install all relevant updates and fixes, and may, at his sole discretion, purchase upgrades, according to the rates set by Licensor. Licensor shall provide any update or Fix free of charge; however, nothing in this Agreement shall require Licensor to provide Updates or Fixes.
